Pavlick John

John Pavlick focuses on government contract law. He provides clients with advice regarding the full spectrum of government contract issues, including advice and representation on bid protests, the preparation and litigation of claims against the government, and prime contractor-subcontractor disputes. He also conducts internal investigations and represents companies with regard to liability under the Civil False Claims Act and suspension and debarment from government contracts. His recent focus has been on homeland security issues, including application of the SAFETY Act to products and services. Based upon his extensive experience in government and private practice, Mr. Pavlick provides aggressive, yet reasoned, representation in a wide variety of issues facing the government contractor. His experience as an Army attorney and interaction with other federal agencies provides an invaluable perspective in deciding how to address issues with the government in the most efficient and effective manner. This includes, in particular, complex issues involving contracts for highly technical equipment and services. His understanding of the often subtle differences between criminal, civil, and contractual liability is reflected in his successful settlement of allegations of fraud at an environmental lab and, in the process, establishing a model now favored by the EPA, for resolving such data fraud issues. Recently, Mr. Pavlick has worked on a variety of government contract transactions totaling hundreds of millions of dollars. These include litigating the terminations of several large defense programs; litigating claims arising out of contract disputes and changes to government contracts; defending against protests of defense contracts; conducting several internal investigations of large companies and addressing potential civil and administrative damages and penalties; defending against Civil False Claims Act investigations; negotiating resolution of suspension and debarment proceedings; successfully resolving an alleged violation of the Civil False Claims Act without liability to the client; preparing company-wide compliance programs; successfully pursuing SAFETY Act applications; and negotiating various contracts for homeland security-related products and services. Mr. Pavlick is a member of the Section of Public Contract Law, the American Bar Association, a vice chair of its Debarment and Suspension Committee and a member of its Commercial Products Committee. He is also a member of the Board of Contract Appeals Bar Association and the National Contract Management Association.
