Noel Francisco

Noel Francisco represents companies and individuals in civil and criminal litigation involving federal and state governments, including lawsuits against governments, enforcement actions by governments, and congressional investigations. Noel represented the Noel Canning Corporation in its successful challenge to President Obama's recess appointments to the National Labor Relations Board. He also represented R.J. Reynolds Tobacco Company in a successful First Amendment challenge to a federal regulation requiring cigarette manufacturers to display graphic warnings on cigarette packages; the Free Enterprise Fund in a successful challenge to the constitutionality of the Public Company Accounting Oversight Board; and the International Coal Group in connection with a congressional investigation into the January 2, 2006 Sago Mine accident in Sago, West Virginia. He also advises clients in matters involving the Foreign Corrupt Practices Act, the Racketeer Influenced and Corrupt Organizations (RICO) Act, the Alien Tort Statute, and the Committee on Foreign Investment in the United States (CFIUS). In 2013, The National Law Journal named Noel as one of "The 100 Most Influential Lawyers in America." Noel is chair of the Jone Days's Government Regulation Practice. He has testified before the House Committee on the Judiciary, Subcommittee on Commercial and Administrative Law on separation of powers, and administration law reform issues. He also provides commentary to the major media on a wide range of legal issues and has appeared on ABC'sNightline, CNN's Larry King Live and Paula Zahn Now, MSNBC's Hardball with Chris Matthews, The NewsHour with Jim Lehrer, and several National Public Radio programs.
