Mike Kennedy is a litigator with broad experience representing clients at all stages of litigation before federal district courts and the Federal Circuit. Mr. Kennedy’s practice is particularly focused on representing pioneer pharmaceutical companies in Hatch-Waxman patent litigation. Mr. Kennedy also has significant litigation experience in the areas of breach of contract, business torts, and insurance coverage. REPRESENTATIVE MATTERS Representing a leading medical device company as a defendant in a correction of inventorship action concerning several patents relating to aspects of dental implant technology. Representing Shire in Hatch-Waxman patent litigation asserting several patents covering Fosrenol®, a drug used to treat a condition associated with chronic kidney disease. Representing a leading manufacturer of acoustic components in patent infringement actions before the International Trade Commission and Northern District of Illinois concerning MEMS microphone package technology. Represented Fougera Pharmaceuticals in Hatch-Waxman patent litigation asserting several patents covering Solaraze®, a drug used to treat actinic keratosis. Represented Fougera in patent litigation involving allegations by GlycoBioSciences, Inc. that Fougera’s Solaraze® product infringes several of its patents. Representing Lattice Semiconductor Corporation in defense of patent litigation concerning alleged infringement of programmable logic patents. Represented Sanofi in Hatch-Waxman patent litigation asserting several patents covering Taxotere®, a drug used to treat several forms of cancer. PREVIOUS EXPERIENCE Mr. Kennedy joined Covington in 2008 from another leading national law firm. U.S. Rep. Thomas E. Petri, Legislative Assistant (2000-2002) PRO BONO Mr. Kennedy maintains an active pro bono practice, including successful representation of an applicant for Social Security disability benefits, and representation of a defendant accused of murder in a case tried to a jury in Prince George’s County, Maryland.
