Robby J. Aliff is a Member of the Firm's Charleston, West Virginia, office. He practices in the Health Care and Finance Practice Group and the Commercial Litigation Practice Group. Currently, he serves as the Assistant Leader of the Commercial Litigation Practice Group and leader of the Medical Professional Liability Team. Mr. Aliff's practice focuses on general, medical and health care litigation as well as banking and general commercial litigation. A substantial part of Mr. Aliff's practice involves the defense of doctors, nurses, hospitals and other health care providers in actions brought under the West Virginia Medical Professional Liability Act (MPLA). He has handled cases involving various medical issues and specialties and has tried MPLA cases involving cardiology, cardiothoracic surgery, oncology, urology, orthopedic surgery, gynecologic surgery, obstetrics, radiology and various nursing care issues. In addition to MPLA and banking cases, Mr. Aliff has defended litigation matters involving defective products and pharmaceuticals in State Circuit Courts and Federal District Courts. He also represents health care providers in disciplinary actions before the West Virginia Board of Medicine, the West Virginia Board of Osteopathy, the West Virginia Board of Examiners for Registered Professional Nurses and the West Virginia Board of Physical Therapy. Mr. Aliff frequently provides counsel to health care providers and medical practices regarding confidentiality, risk management and maintaining medical records. Mr. Aliff has presented various lectures on important issues to health care providers, including "Medical Malpractice 101," "Risk Management: Preventing Malpractice Lawsuits," "Medical Record Charting" and "Health Care Directives." He participates in Grand Rounds for the Departments of Family Medicine, Internal Medicine, Obstetrics and Gynecology and Pediatrics at Charleston Area Medical Center and also speaks at the Annual Patient Care Symposium at Thomas Memorial Hospital. Mr. Aliff was a presenter at the West Virginia CLE, Litigation 2001 conference at Canaan Valley Resort on the topic of "Obtaining Medical Records by Subpoena." He also spoke at the 2009 Litigation CLE on "Drug and Medical Device Litigation." In 2003, Mr. Aliff and Tom Hurney authored "Medical Professional Liability in West Virginia," in the West Virginia Law Review. Mr. Aliff presented "Expert Depositions 101: Defending the Expert Deposition," at the Defense Trial Counsel of West Virginia 2006 Deposition Boot Camp. In June 2008, Mr. Aliff co‑authored, "Challenges to Affidavit of Merit Requirements" in For The Defense with fellow Jackson Kelly attorneys Tom Hurney and Jennifer Mankins. Mr. Aliff currently serves on the State of West Virginia Lawyer Disciplinary Board and as a member of the Defense Research Institute and the Kanawha County Bar Association. Mr. Aliff volunteers for various organizations throughout the state, including Leadership West Virginia, the West Virginia Governor's Schools Advisory Council and the Charleston Chapter of the Washington and Lee University Alumni Association. He currently serves on the board of directors for the Washington and Lee University Alumni Association and is active at Christ Church United Methodist. Mr. Aliff was a 2007 recipient of The State Journal Generation Next, 40 Under 40 award. He also participated in the 2006 Leadership West Virginia program and is currently a Lifetime Member of Leadership West Virginia. Mr. Aliff graduated from Washington and Lee University with a Bachelor of Arts, cum laude, in psychology in 1991 where he was inducted into the Omicron Delta Kappa National Leadership Honor Society. He then graduated from Washington and Lee University School of Law, with a Juris Doctor in 1997. He was a member of Phi Alpha Delta and participated in the Alderson Prison Practicum. While at Washington and Lee, Mr. Aliff was the recipient of the J.E. Lewis Scholarship.
