An interesting historical reference to the USA’s current challenge is a Supreme Court case from 1905 where the court upheld the Cambridge Board of Health’s vaccination efforts during the smallpox epidemic. In the decision, Justice John Marshall Harlan wrote “upon the principle of self-defense, of paramount necessity, a community has the right to protect itself against an epidemic of disease which threatens the safety of its members.” This country has handled pandemics before and we can do it again.
