Harry Silver

Harry Silver focuses his practice on representing health care providers involved in litigation stemming from alleged violations of the Federal False Claims Act, including qui tam suits. Mr. Silver has had considerable success in obtaining the dismissal of complex qui tam cases at early stages of litigation, or in obtaining summary judgment before trial. His work in this area also encompasses counseling, representation during the course of a government investigation, litigation in trial and appellate courts, negotiating settlements, and conducting internal investigations. Mr. Silver has significant experience in Medicare and Medicaid reimbursement litigation and APA rulemaking challenges. Mr. Silver also represents government contractors in False Claims Act suits, in the negotiation and review of contracts and proposals, and in counseling clients with respect to contract financing, prime and subcontractor relationships, Buy America requirements, and issues under the Foreign Corrupt Practices Act. He represents debarred or suspended contractors and handles the prosecution and defense of bid protests and contract disputes before the General Accounting Office, Board of Contract Appeals, U.S. district courts, the U.S. Court of Federal Claims, and the U.S. Court of Appeals for the Federal Circuit. Earlier in his career, Mr. Silver worked in the general counsel’s office of the U.S. Department of Energy, as a staff attorney in the Appellate Section, Civil Division, U.S. Department of Justice, and as a law clerk to the Hon. Harold R. Medina, U.S. Court of Appeals for the 2nd Circuit.
