Sarah A Franklin

Sarah Franklin's practice focuses on white collar criminal defense, internal investigations, and complex civil litigation. She has represented corporate and individual clients in criminal and civil investigations by the Department of Justice, HHS OIG, FDA, and state Attorneys General, as well as internal investigations, congressional inquiries, and multi-district False Claims Act litigation. Ms. Franklin draws on her experience in defending government investigations to advise pharmaceutical and device manufacturers on advertising and promotion, fraud and abuse issues, and other compliance matters. Ms. Franklin also has extensive experience with electronic discovery. She combines technical expertise with practical experience in managing the day-to-day operations of document intensive cases to counsel corporate clients on cost-effective electronic discovery practices and document retention policies. Prior to entering private practice, Ms. Franklin investigated and prosecuted consumer protection violations for the Federal Trade Commission, including scams based on novel uses of Internet technologies. REPRESENTATIVE MATTERS Represent numerous pharmaceutical and device manufacturers in federal and state investigations of sales and marketing activities, pricing, and good manufacturing practices, as well as related qui tam litigation. Represented pharmaceutical and device manufacturers in congressional investigations related to support of independent medical education. Represented the Special Committee of the Board of Directors of a publicly traded company in an internal investigation of potential securities violations. Counseled sports league and pharmaceutical industry clients on document retention policies and preservation obligations for electronic information.
