Representing AstraZeneca in class action litigation consolidated in the District of Massachusetts involving allegations of unlawful settlements of Hatch-Waxman ANDA patent litigation. In re Wellbutrin XL Antitrust Litigation. Representing Valeant Pharmaceuticals International (formerly Biovail Corporation) in class action litigation consolidated in the Eastern District of Pennsylvania involving allegations of sham litigation. In re Optical Disk Drive Antirust Litigation. Represented four defendants in antitrust class actions alleging price fixing by the manufacturers of optical disk drives. In re K-Dur Antitrust Litigation. Represented a pharmaceutical company in a number of direct and indirect purchaser class actions in federal court alleging violations of the Sherman Act and state antitrust laws arising out of settlements of patent litigation with generic drug manufacturers. ZF Meritor LLC v. Eaton Corporation. Represented Eaton in antitrust case brought by a competitor alleging monopolization and other antitrust claims arising from agreements to supply heavy duty truck transmissions to the heavy duty truck manufacturers. In re Biovail Corporation Securities Litigation. Represented pharmaceutical company and senior executives in a securities class action that settled before trial. Miller v. Dyadic International. Lead counsel for company and current and former officers and directors in securities fraud litigation that settled before extensive discovery or class certification briefing. In re Alcon Shareholder Litigation. Represented Nestlé SA and directors in class action litigation in New York and Texas arising from Nestlé’s sale of Alcon, Inc. to Novartis AG. Successfully negotiated dismissal of Nestlé and the directors in all cases without filing a motion to dismiss or engaging in extensive jurisdictional discovery.
