James C McKay

James C. McKay is a senior counsel whose practice specialties are general litigation, trial and appellate, antitrust and trade regulation, criminal, and civil. He was assistant U.S. Attorney for the District of Columbia, 1948-49; and was appointed Independent Counsel in the investigations of Lyn Nofziger and Edwin Meese, III, February 1987 to September 1, 1988. Cases on which he was counsel cases include Jakanna Woodworks, Inc. v. Montgomery County, Md., 689 A. 2d 65 (Md. 1997) (concerning commercial free speech under the First Amendment); Daniels v. Gober, 10 Vet. App. 474 (1997) (concerning veterans law issues, statutory interpretations); United States v. Nofziger, 878 F.2nd 442 (D.C.Cir. 1989) (an Independent Counsel prosecution under the Ethics in Government Act); Mid-South Grizzlies v. National Football League, 55 F. Supp. 558 (E.D. Pa. 1982), aff'd., 720 F.2d 772 (3rd Cir.) (antitrust law as applied to professional sports); PEPCO v. Westinghouse Electric Corp., 385 F. Supp. 572 (D. D.C. 1974) (alleged fraud; breach of contract); Smith v. Pro Football, Inc., 420 F. Supp. 738 (D. D.C. 1976) (antitrust law as applied to professional sports); Mackey v. National Football League, 543 F.2d 606 (8th Cir. 1976) (antitrust law as applied to professional sports); and Hecht v. Pro Football, Inc., 444 F.2d 431 (D.C. Cir. 1971) (antitrust law as applied to professional sports). He is a Fellow of the American College of Trial Lawyers and a Fellow of the American Bar Foundation. He was a member of the Board of Professional Responsibility of the District of Columbia Court of Appeals from 1991 to 1997. HONORS AND RANKINGS Mr. McKay received a Lifetime Achievement Award from The American Lawyer on October 29, 2008. United States Court of Appeals for Veterans Claims, Hart T. Mankin Distinguished Service Award (2008) In July of 2007, Mr. McKay received a Certificate Merit from President George W. Bush at a special session of the U.S. Court of Appeals for Veterans Claims relating to his work on behalf of veterans.
