Jerry Hoffman leads Wilson Elser’s Health Care practice based in Albany, NY. In conjunction with the firm’s Government Relations practice, Jerry assists clients in meeting the daunting challenges of an ever-changing health care environment by finding innovative ways to ease their regulatory burdens and providing creative, cost-effective strategies to complete their transactions. The Health Care practice is particularly adept at helping clients implement new organizational structures and delivery modalities and obtain funding for innovative projects. Jerry and his team also work closely with clients to secure government authorization for their projects. Jerry brings many years of practical experience to his work. His corporate law background coupled with his long tenure working in government relations allows Jerry to provide health care clients with straightforward guidance to meet their regulatory requirements and business goals. Clients often call on Jerry to facilitate projects that bridge the corporate and government worlds. Jerry joined Wilson Elser after serving as vice president of government relations at the Healthcare Association of New York State. He also served as legislative counsel for the Medical Society of the State of New York. Jerry began his career as a corporate and securities attorney in New York City. Areas of Focus Health Care Jerry’s extensive list of clients includes hospitals, nursing homes, adult care facilities, long-term home health care programs, managed long term care plans, assisted living programs, home care agencies (both certified and licensed), physicians and physician groups, independent practice associations and adult day care programs. As general counsel to many health care providers, Jerry and his team have steadfastly helped clients navigate the complex and inconsistent world of health care delivery and reform. He works closely with clients to improve their operations and governance and accomplish their transactional and regulatory goals. Jerry has counseled clients in the formation and operation of multi-hospital networks and in the development of new facilities and health care delivery entities. He is experienced at handling a wide array of health care transactions, including contract structuring and negotiation, asset sale and purchase agreements, and physician-hospital ventures, as well as regulatory requirements under both the fraud and abuse and tax-exempt organization rules. Jerry also counsels hospitals and other health care clients on day-to-day issues such as physician recruitment, contracting and discipline issues, governance and administrative matters, vendor contracting and other operational matters. On the regulatory front, Jerry represents health care providers and other clients in their varied interactions with government agencies both in New York State and nationally, including, but not limited to, the New York State Department of Health, New York State Attorney General’s Office, New York State Division of the Budget, New York State Energy Research and Development Authority, Department of Education, Department of Financial Services, Office of Mental Health, New York State Comptroller’s Office, and the Centers for Medicare and Medicaid Services. Jerry and his team assist clients in developing compliance plans and managing and fighting complex government investigations. He also counsels clients on the intricacies of fraud and abuse laws and regulations as well as the complexities of the HIPAA and HITECH regulatory framework.
