BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTIONA1.AASubchapter A, Chapter 28, Education Code, is amendedbyaddingSection28.020toreadasfollows: Sec.A28.020.AAMATHEMATICS INNOVATION ZONES. (a) The commissionermay: (1)AAon application of a school district or open-enrollmentcharterschool,designateacampusofthedistrict orschoolasamathematicsinnovationzone;and (2)AAfrom funds appropriated or donated for purposes of thissection,awardagranttosupportimplementationofinnovative mathematics instruction at the campus in accordance with this section. (b)AAA campus designated as a mathematics innovation zone must: (1)AAimplement with fidelity an innovative mathematics instructionalprogramapprovedbythecommissionerforpurposesof this section that addresses the essential knowledge and skills of themathematicscurriculumrequiredbySection28.002; (2)AAcomply with objectives, metrics, and other mathematics innovation zone requirements imposed by the By:AAParker H.B.ANo.A2014 85R5756 KKA-F 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 H.B.ANo.A2014 commissionerthroughrulesadoptedunderSubsection(g);and (3)AAprovide all data relating to the mathematics innovationzonerequestedbytheagency. (c)AAA campus designated as a mathematics innovation zone is notsubjecttointerventionsunderthestateaccountabilitysystem describedbySection39.107(a)or(e)forthefirsttwoyearsofthe designation,providedthatthecampusimplementstheinstructional programwithfidelityandcomplieswitheachmathematicsinnovation zone requirement to the satisfaction of the commissioner. The period that a campus is exempt from interventions as provided by thissubsectionisnot: (1)AAincluded in calculating consecutive school years underSection39.107(a)or(e);or (2)AAconsidered a break in consecutive school years of unacceptable ratings for purposes of determining the need for interventionunderSection39.107(a)or(e). (d)AAThe commissioner may revoke designation of a campus as a mathematicsinnovationzoneandsuspendassociatedgrantfundingif thecommissionerdeterminesthatthecampushasfailedtoimplement the instructional program with fidelity or comply with any requirementimposedunderthissection. (e)AAA school district or open-enrollment charter school may use a pay for success program approved by the commissioner under Section44.904topaycostsassociatedwithdesignationofacampus asamathematicsinnovationzone. (h)AAA decision or determination by the commissioner under thissectionisfinalandmaynotbeappealed. SECTIONA2.AASubchapter Z, Chapter 44, Education Code, is amendedbyaddingSection44.904toreadasfollows: Sec.A44.904.AAPAY FOR SUCCESS PROGRAMS. (a) In this section, "pay for success program" means a program involving privatefinancingunderwhichpaymentsaredependentonachievement ofmeasurableoutcomes. (b)AAThe commissioner may: (1)AAstructure and approve pay for success programs for usebyaschooldistrictoropen-enrollmentcharterschool; (2)AAevaluate and approve the following participants in apayforsuccessprogram: (A)AAa private investor; (B)AAan education service provider; and (C)AAa third-party evaluator; and (3)AArequire an approved participant to comply with the objectives,metrics,andotherpayforsuccessprogramrequirements prescribedbythecommissioner. (c)AAIn evaluating a potential participant under Subsection (b)(2),thecommissionermay: (1)AAverify the availability and liquidity of the investmentfundsofaprivateinvestor; (2)AAevaluate the credentials and effectiveness of an educationserviceprovider;and 3 1 2 3 4 5 6 7 8 9 10 11 12 13 H.B.ANo.A2014 (3)AAevaluate the credentials and independence of a third-partyevaluator. (d)AANotwithstanding any other law, a school district or open-enrollmentcharterschoolthatusesapayforsuccessprogram approved by the commissioner is not subject to state procurement requirements that would otherwise apply to the activity funded throughtheprogram. (e)AAThe commissioner, the agency, and agency employees are immunefromliabilityforactionsassociatedwiththestructuring, approval,orimplementationofapayforsuccessprogram. (f)AAThe commissioner may adopt rules as necessary to implementthissection. SECTIONA3.AAThis Act takes effect September 1, 2017. 4
